Analysis: USCIS policy memo clarifying eligibility criteria for H-1B third-party placements

U.S. Citizenship and Immigration Services issued a policy memorandum on Feb. 22 clarifying what kinds of evidence will be necessary to establish eligibility for H-1B status when the beneficiary will be employed at one or more third-party worksites. The memorandum became effective upon its issuance and adjudicators will apply the new guidance to all new H-1B petitions as well as requests to extend or amend H-1B status.
