The Labor Department has posted processing times as of Oct. 1 for permanent labor certification (PERM) applications.

  • The agency is currently processing analyst reviews for PERM applications filed in July 2016 and earlier. Audit reviews are being conducted on applications filed in February 2016 and earlier, and appeals filed in August 2016 and earlier are being reviewed for reconsideration. The processing queue is current for cases that have been appealed based on government error.
  • The Labor Department has not yet posted new processing times this monthsfor prevailing wage determinations. As of Sept. 1, however, the National Prevailing Wage Center was processing requests for prevailing wage determinations filed in May 2016 and earlier for H-1B and PERM cases. Redeterminations were being considered on appeals filed in May 2016 and earlier for H-1B and PERM cases. Center Director Reviews were being conducted on appeals filed in May 2016 for H-1B and PERM cases.

BAL Analysis: BAL’s internal case tracking is consistent with the Labor Department processing times. BAL is seeing approvals for PERM applications filed in July 2016 or earlier and awaiting prevailing wage determinations for requests filed in May 2016.
