IMPACT – MEDIUM

What is the change? Employers are reminded to submit their biannual list of foreign employees to the Labour Commissioner by June 30.

What does the change mean? The list must detail all foreign national employees who are employed by the Tanzanian employer at the time of filing and all foreign national employees who have left the employ of the Tanzanian employer, and their Tanzanian national successors, since the last biannual filing that was due Dec. 31.

  • Implementation time frame: The filing deadline is June 30.
  • Who is affected: All Tanzanian companies that currently employ foreign nationals or have employed foreign nationals since Dec. 31, 2016 are required to file the form.
  • Business impact: Companies that fail to file employee lists are subject to penalties.
  • Next step: Employers should plan to submit the list manually using the standard form (available here). BAL can assist in the process.

Background: Under the Tanzanian Non-Citizens (Employment Regulation) Act 2015, implemented in September of 2015, employers are required to submit a biannual list in the form of a “Return on Employment of Non-Citizens” by June 30 and Dec. 31 every year. The list must detail the total number of foreign and Tanzanian employees, all foreign nationals employed by the company at the time of filing and all foreign nationals who have left the employ of the company, and their Tanzanian national successors, since the last biannual filing that was due Dec. 31. Employers are reminded that if they fail to file by the deadline, the Labour Commissioner may deem them noncompliant.

BAL Analysis: Employers should be sure to meet the June 30 deadline to submit their report to the Labour Commission. Those in need of assistance should contact BAL.
